Logo design to satisfy US Patent Agency

Our Logo, AW NRTL black/white is too similar to four others, attached, and will be rejected by USPTO. So please ask your designers to create some new designs using the Patent Agents directions: I provide a few additional comments on your points below for your further consideration. 1) Must be un-mistakenly different of Sole’s logo [Patrick:] Conceptually, I agree with your point that your updated logo and SOLE’s logo are different. However, the USPTO will focus on the key elements of the respective marks. The dominant elements of your mark are the Greek letters Alpha and Omega, and those two elements are key elements within SOLE’s logo and your addition of the letter “N” and the bar are not sufficient to distinguish the respective marks, because those two elements are secondary in size and commercial impression to the Alpha and Omega in your mark. Brad and I suggest that you consider adding an element that further distinguishes your mark from SOLE’s mark. Perhaps using a triangle or Delta character and moving the bar and the Alpha and Omega to create a see-saw or teeter-totter design, where the Alpha and Omega are on opposite ends of the teeter-totter. I don’t want to suggest that such a modified design would sail through the USPTO without issue, but a design with such elements would allow us to more opportunity to argue about the notable differences in the respective marks. 2) Greek symbols Alpha and Omega [Patrick:] The USPTO requires applicants to accurately describe all elements in their marks that are not comprised of the letters from English alphabet, whether the elements are designs only or letters from alphabets of other languages. In this case, the USPTO will consider the two letters in your proposed mark as depicting the Greek letters Alpha and Omega, so the USPTO will refuse to register your mark if you do not agree to describe them as such.
